Terms of use of services

The information below is a set of rules for using the services provided through the website. These rules form part of the official offer to use these services.

 

These rules constitute a public contract of accession and have legal force in accordance with applicable law. The terms of the terms of use are the same for all users and cannot be changed by the other party to the contract.

 

Registration of the Customer in the accounting system on the server of the Contractor is considered a full and unconditional acceptance of the rules of use.

1.    Terms of use of hosting services

1.1. It is forbidden to exceed the limits of services (resources) provided by the Contractor in accordance with the selected tariff plan for more than 30 seconds.

 

1.2. The Contractor is not responsible for unauthorized access to the Customer's web system, which may cause errors, interruptions in work, deletion of files, change of functions, etc.

 

1.3. To prevent unauthorized access to the web system, unauthorized distribution and distribution of viruses or other malicious programs, the Contractor uses tools developed by third parties on its equipment. However, these measures cannot guarantee full effectiveness in stopping such phenomena, and the Contractor is not responsible for them.

 

1.4. It is the customer's responsibility to use the MySQL database in a manner that does not harm the overall performance of the server. Otherwise, the Contractor may restrict access to this resource.

 

1.5. When providing hosting services, the Contractor does not initiate the transfer of information, does not select the recipients of this information, does not control the integrity of the transmitted information and is not responsible for the accuracy, quality and content of information stored, published or distributed by the Customer using the services provided.

 

1.6. The Contractor is not responsible for the violation of the rights of third parties arising from the actions of the Customer when using the services provided by the Contractor.

 

1.7. The Contractor has the right to temporarily suspend the provision of services in accordance with this Agreement if the Customer uses the services for:

  • Advertising services, goods or other materials, the distribution of which is prohibited or restricted by applicable law.
  • Using false return email addresses when sending emails.
  • Commission of actions or mediation in actions aimed at disrupting the normal functioning of the elements of the Internet.
  • Publication or dissemination of information that is contrary to international law.
  • Use of intellectual property objects without the permission of the copyright holder.
  • Distribution of computer viruses or malicious software.
  • Reproduction or distribution of copyrighted software without the permission of the owner or copyright owner.
  • Sending "chain" messages of any type.
  • Spam mailings, i.e. electronic messages sent to Internet users without their prior consent and/or messages in which the sender is not specified or the sender's address is false.
  • Attempts of unauthorized access to the Contractor's resources or other systems accessible via the Internet.
  • Publishing or carrying out actions aimed at deceiving, hacking software or performing other similar actions.
  • Placement of programs that hide the real IP address of the client and are capable of performing illegal actions.
  • Hosting anonymous online conferences and IRC servers.
  • Placing pharmaceutical sites, as well as offering the sale of drugs without official permits or posting information advertising the sale of chemicals belonging to the group of drugs, psychotropic drugs or precursors.
  • Dissemination of classified and personal information without official permission to distribute such data.
  • Launching public bit-torrent and any P2P applications.
  • Implementation of illegal or unauthorized access to computer systems and networks, both belonging to the Contractor and third parties.
  • Using the service as a transit proxy server between the UA-IX environment and the global Internet or vice versa.
  • Using the service with incorrect system settings that adversely affect the performance of the Contractor's equipment and complicate the provision of the service to other users.
  • The use of anonymizers.

 

1.8. The Contractor also has the right to temporarily suspend the provision of services in accordance with this Agreement if messages (complaints) are received from the Contractor about spamming, which is carried out using the Customer's web system or advertises it.

 

1.9. The Contractor has the right to temporarily suspend the provision of services without prior notice to the Customer in the following cases:

 

  • If, based on the justified opinion of the Contractor, the use of services by the Customer may cause harm to the Contractor and / or lead to failures in the hardware and software of the Contractor and / or third parties.
  • Any actions of the Customer related to the publication, distribution, mailing or transmission of information or software containing viruses or other harmful components.
  • Any actions of the Customer related to the publication, distribution, distribution or transmission of information or software containing computer codes, files or programs designed to disrupt, destroy or limit the functionality of computers, computer or telecommunications equipment or programs for unauthorized access.
  • Any actions of the Customer related to the publication, distribution, distribution or transmission of information or software containing serial numbers for commercial software products and programs for their generation, logins, passwords and other means to obtain unauthorized access to paid resources on the Internet, as well as when linking to the above information.

1.10. The Contractor provides a free relocation service (website/sites transfer) from another hosting (except the Contractor's hosting) to virtual hosting when paying for hosting services for a quarter. The issue of free moving when paying for 1 month, as well as the number of free transferred sites is decided individually with the Customer. In the event of a complex and/or time-consuming transfer, the Contractor may ask the Customer to pay for the virtual hosting service for a longer period or issue an invoice for the transfer service in accordance with the current payment system for the work of technical specialists. The cost of such a service must be reported to the Customer. The Contractor reserves the right to refuse the transfer for technical reasons and undertakes to inform the Customer about this before or during the process of moving.

 

1.11. When using the services, it is prohibited:

 

  • Restrict other users' access to the Internet or prevent them from using the network.
  • Use the services to interfere with the computer systems of the Contractor, its clients or other networks on the Internet. This includes banning DoS, DDoS, SYN-flood, UDP-flood and other destructive attacks.
  • It is illegal to gain access to the computer systems and networks of the Contractor, as well as systems and networks of third parties accessible via the Internet. This includes the prohibition of guessing passwords, attempts to gain unauthorized access to third party systems, and the creation of illegal networks.
  • Use the service as a transit proxy server between the UA-IX network and the global network or perform actions aimed at anonymous access to external networks using a virtual server, such as TOR and other networks designed to hide network activity or create IRC servers.
  • Place programs designed to hide the real IP address of the client and commit illegal actions. This includes banning public and private/private proxy programs (eg 3proxy, TOR) and other similar programs, as well as iptables settings related to proxying (port forwarding).
  • Place domains in zones (TLD) registered in Russia and Belarus, such as .ru, .su, .rf, .moscow, .moscow, .ru.com, .ru.net, .rus, .children, .online, .site, .bel, .by and others.
  • Carry out commercial and non-commercial activities for the sale, resale and distribution of information (software and other products), if the Customer is not the copyright holder or does not have permission from the copyright holder.
  • Use file sharing.
  • Use hosting services as a financial pyramid (HYIP/HYIP).
  • Use hosting services as an online casino.
  • Use hosting services as a gambling business.
  • Use hosting services to host doorways (doorways) - sites or web pages that are optimized to get high positions in search results for certain queries.

2. Rules for using VPS server services

 

2.1. When using email services, the Customer undertakes to comply with the following conditions:

 

  • Sending no more than 1000 emails from one VPS within 1 hour.
  • Each letter sent by the Customer must not contain more than 20 recipients.

 

2.2. If a vulnerability is found in the operation of the VPS server, the Contractor has the right to carry out up to 2 reboots of the Customer's VPS within 1 month without prior notice to install updates or eliminate critical vulnerabilities. This rule applies only to VPS for which the "Full administration" service has been paid for and activated.

 

2.3. If 5 TB of traffic in the use of the VPS service is exceeded, the Contractor has the right to reduce the speed of the server interface to 10 Mbps until the end of the current calendar month. From the beginning of the next month, the speed will be restored to its original value.

 

2.4. Traffic usage is regulated by the tariff plan. If the traffic limit set by the tariff is exhausted, the Customer can purchase additional traffic or switch to a higher tariff plan. Funds paid for additional traffic are non-refundable. If the VPS exceeds the monthly traffic limit, the service may be temporarily blocked until the beginning of the next period.

 

2.5. The allocated disk space is determined by the tariff plan. Up to 4 GB of disk space may be occupied by the system and not available for downloading content. The customer can order additional disk space or upgrade to a higher tariff plan. Paid funds for additional disk space are non-refundable.

3. Rules for using virtual hosting services

3.1. When using the services of the Contractor, the Customer must comply with the following requirements:

  • The number of database requests should not exceed 10% of the total number of requests on the server that are longer than 1 second at any given time.
  • Each account must not use more than 10% of the server's CPU time for more than five seconds.
  • No more than 20 PHP processes should be running at the same time.
  • Running cron scripts is allowed no more than once every 15 minutes. It is forbidden to execute more than five cron scripts at the same time.
  • Connection to MySQL and PostgreSQL database services is allowed only through site scripts hosted on the same server. It is forbidden to connect virtual hosting accounts to database services from outside, including VPS and third-party servers.

3.2. Using the disk subsystem

 

  • At least 90% of the information posted on the Customer's website must consist of HTML pages and similar pages.
  • Placing standard design pages consisting of HTML-based text and graphics is allowed. Uploaded files, media files and streaming content must not exceed 10% of the total used space on the server or be more than 500 KB.

When using the services of the Contractor, the Customer undertakes to comply with the following restrictions:

 

  • Audio, video and other media files (eg .avi, .mp3, .mpeg, .jpg, .gif) should not exceed 5000 MB of disk space on the server.
  • Archives and images should not take up more than 5000 MB of disk space on the server.
  • Databases, including sql files and database dumps, should not take up more than 5000 MB of disk space on the server.
  • Executable files and other files resulting from the compilation of programs should not occupy more than 5000 MB of disk space on the server.
  • Email files should not take up more than 5000 MB of disk space on the server.
  • If the limits are regularly exceeded (more than 5 times), the Contractor has the right to temporarily suspend the service.

 

3.3. Using email services

 

When using email services, the Customer undertakes to comply with the following conditions:

  • Sending no more than 200 emails from one domain within 1 hour.
  • Each letter sent by the Customer must not contain more than 20 recipients.
  • IMAP-configured mail clients are only allowed for mailboxes that are less than 5 GB in size.
  • The use of email clients with the configured POP3 protocol is allowed only for mailboxes that are less than 1 GB in size.
  • If the mail client is using the POP3 protocol, the allowed number of checks is 100 times per hour.
  • Mail must be sent through a third-party SMTP server, and other software to bypass the local mail service is not allowed.

4. Rules for using VIP hosting services

 

4.1. When using the services of the Contractor, the Customer must comply with the following requirements:

  •  
  • The number of database requests should not exceed 10% of the total number of requests on the server that are longer than 1 second at any given time.
  • Each account must use no more than 20% of the entire server's CPU time for more than five seconds.
  • No more than 40 PHP processes should be running at the same time.
  • Cron scripts should not run more than once every 15 minutes. It is forbidden to execute more than five cron scripts at the same time.
  • Connection to MySQL and PostgreSQL database services is allowed only through site scripts hosted on the same server. It is forbidden to connect virtual hosting accounts to database services from outside, including VPS and third-party servers.

4.2. Using the disk subsystem

 

  • At least 90% of the information posted on the Customer's website must consist of HTML pages and similar pages.
  • Placing standard design pages consisting of HTML-based text and graphics is allowed. Uploaded files, media files and streaming content must not exceed 20% of the total used space on the server or be more than 500 KB.
  • When using the services of the Contractor, the Customer undertakes to comply with the following restrictions:

  • Archives and images should not exceed 20,000 MB of disk space on the server.
  • Databases, including sql files and database dumps, should not exceed 20,000 MB of disk space on the server.
  • Executable files and other files resulting from the compilation of programs should not occupy more than 20,000 MB of disk space on the server.
  • Email files should not take up more than 20,000 MB of disk space on the server.
  • If the limits are regularly exceeded (more than 5 times), the Contractor has the right to temporarily suspend the provision of the service.

4.3. Using email services

 

  • When using email services, the Customer undertakes to comply with the following conditions:
  •  
  • Sending no more than 500 emails from one domain within 1 hour.
  • Each letter sent by the Customer must have no more than 20 recipients.
  • IMAP-configured mail clients are only allowed for mailboxes that are smaller than 10,000 MB.
  • The use of email clients with the POP3 protocol configured is only allowed for mailboxes that are smaller than 10,000 MB.
  • If the mail client is using the POP3 protocol, the allowed number of checks is 100 times per hour.
  • It is allowed to send mail bypassing the local mail service only through a third-party SMTP server. Sending mail by any other software means bypassing the local mail service is prohibited.

5. Rules for using reseller hosting services

 

5.1. When using the services of the Contractor, the Customer is obliged to comply with the requirements corresponding to the package chosen by him. The Customer also undertakes to ensure that each Reseller's customer complies with the following restrictions:

 

  • The number of database requests should not exceed 10% of the total number of requests on the server that are longer than 1 second at any given time.
  • Each account must not use more than 10% of the entire server's CPU time for more than five seconds.
  • No more than 10 PHP processes should be running at the same time.
  • Cron scripts should not run more than once every 15 minutes. It is forbidden to execute more than five cron scripts at the same time.
  • Connection to MySQL and PostgreSQL database services is allowed only through site scripts hosted on the same server. It is forbidden to connect virtual hosting accounts to database services from outside, including VPS and third-party servers.


5.2. Using the disk subsystem

 

These limits apply to each reseller customer.

 

  • The information posted on the Customer's website must consist of 90% or more of HTML pages and similar pages. Placing standard design pages consisting of HTML-based text and graphics is allowed. Downloads, media files, streaming content, or files larger than 500 KB must not exceed 10% of the total used server space.

When using the services of the Contractor, the Customer undertakes to comply with the following restrictions:

 

  • Audio, video and other media files (eg .avi, .mp3, .mpeg, .jpg, .gif) should not exceed 5000 MB of disk space on the server.
  • Archives and images should not take up more than 5000 MB of disk space on the server.
  • Databases, including sql files and database dumps, should not exceed 20,000 MB of disk space on the server.
  • Executable files and other files resulting from the compilation of programs should not occupy more than 5000 MB of disk space on the server.
  • Email files should not take up more than 5000 MB of disk space on the server.
  • The number of inodes used must not exceed 200,000 for each account created by the reseller.
  • If the limits are regularly exceeded (more than 5 times), the Contractor has the right to temporarily suspend the provision of the service.

5.3. Using email services

 

These limits apply to each reseller customer.

 

  • When using email services, the Customer undertakes to comply with the following conditions:
  • Send no more than 200 emails from one domain within 1 hour.
  • Each letter sent by the Customer must have no more than 20 recipients.
  • IMAP-configured mail clients are only allowed for mailboxes that are less than 5 GB in size.
  • The use of email clients with the POP3 protocol configured is only allowed for mailboxes that are less than 1 GB in size.
  • If the mail client is using the POP3 protocol, the allowed number of checks is 100 times per hour.
  • It is allowed to send mail bypassing the local mail service only through a third-party SMTP server. It is forbidden to send mail by any other software means bypassing the local mail service.

5.4. The Contractor has the right to completely or partially suspend the provision of services to the reseller's clients in cases provided for by the Public Offer and the Rules for using the services, without prior additional warning to the reseller's client. The customer will be notified of the total or partial suspension of the service for his client. The customer has the right to unblock the customer's account.

6. Rules for using domain registration and renewal services

 

6.1. Terms and conditions for the provision of domain registration services and the validity period of a domain are defined in this Agreement, as well as in the rules for registering domains applied when registering domains in the corresponding domain name zone.

 

6.2. An unpaid domain registration service order is not a domain name reservation by the Contractor for the Customer.

 

6.3. When using domain registration and renewal services, the Customer undertakes to comply with international law.

 

6.4. The Customer independently monitors the domain name registration expiration date, and the Contractor shall not be liable for the consequences associated with the expiration of the domain registration period, if the Customer has not ordered a timely domain renewal or if the Contractor has not provided the domain renewal service due to the Customer's violation of the terms of the Agreement.

7. Rules for using SSL certificate registration services

7.1. The customer undertakes not to use the services for purposes contrary to international law.

 

7.2. The Customer is responsible for the violation of applicable law committed by him or a third party through the use of services provided by the Contractor.

 

8. Rules for using the Cloud VPS OS service

Terms and Definitions

Planned technical work is a set of technical operations performed by the Contractor in a certain period of time to maintain the health of the servers.

Emergency technical work is a set of technical operations performed by the Contractor on servers outside the scope of the planned technical work in order to eliminate the reasons for the unavailability of the services provided to the Customer. These works may include the installation of critical updates, patches, replacement of failed equipment and other urgent measures necessary to maintain the health of the servers. When carrying out emergency technical work, the Contractor undertakes to take all possible measures and warn the Customer about such work as soon as possible.

The reporting period is a period equal to one calendar month, from the first to the last day.

Basic technical support is a type of support that includes:

 

  • Consultations on working with the infrastructure control panel.
  • Assistance in transferring data from other servers to VPS in the Contractor's infrastructure.
  • Setting up backup to remote servers of the Contractor.
  • Installation and configuration of standard services (nginx, apache, mysql, php, postfix, proftpd, bind).
  • Installing standard PHP/Nginx/Apache modules.
  • OS installation based on the Executor's image.
  • Installation of a hosting control panel supported by the Contractor (DirectAdmin, WHM/cPanel, Webuzo). The license for the control panel is paid separately by the Customer.

8.1. Service Description

 

The service is an infrastructure service (IaaS), which allows the Customer to use the Contractor's IT infrastructure to host their own information systems.

 

8.2. How to provide basic technical support

 

The Contractor undertakes to provide the Customer with basic technical support in the form of tickets. The maximum processing time for the Customer's request in the ticket system is no more than 4 hours.

 

8.3. Guarantees and compensation

 

The Customer has the opportunity to contact the technical support service of the Contractor using the ticket system within 24 hours a day and 7 days a week.

 

8.3.1. Planned technical work

 

The Contractor reserves the right to carry out planned technical work, which may lead to a temporary interruption in the provision of the service. The Contractor undertakes to notify the Customer about the planned technical work 72 hours before their start. The time of unavailability of the service as a result of such work should not exceed 4 hours for the reporting period. If the unavailability of the service as a result of such work exceeds 4 hours during the reporting period, the Customer is entitled to receive compensation in accordance with clause 8.3.4.

 

 

8.3.2. Emergency technical work

 

The contractor has the right to carry out emergency technical work. In the case of such work, the Contractor reserves the right to notify the Customer immediately before the start of a break in the provision of services. The unavailability of the service will be equal to the actual time required to fix the problem or prevent a critical situation. Service interruptions caused by urgent work are not subject to compensation and are not taken into account when calculating the availability of the service.

 

8.3.3. Service interruptions are not subject to compensation if they are caused by:

 

changes in the settings made by the Customer, which directly or indirectly affected the receipt or provision of the service;

delays or defects in the operation of the service associated with the software installed by the Customer;

hacking of the Customer's infrastructure by third parties;

force majeure circumstances.

 

8.3.4. The Contractor undertakes to do everything possible to ensure the availability of the service at a level of at least 99.9% during the reporting period. The unavailability of the service should not exceed 4 hours during the reporting period. If the level of service availability for the reporting period falls below the stated 99.9%, the Customer is entitled to compensation according to the table below.

The percentage of service availability is calculated by the formula:

 

Availability = 100 − (100 ⨯ (Downtime in Hours) / Hours in Billing Period)

 

Compensation is provided to the customer by deducting the amount of compensation from the cost of the service for the next billing period in accordance with the table. When calculating compensation, the average amount of the Customer's expenses for the Contractor's services for 3 preliminary billing periods is used. Compensation is calculated according to the formula:

 

Compensation amount = (Sum of costs for 3 billing periods / 3) ⨯ (Compensation percentage / 100)

 

If the Customer uses the services of the Contractor for less than three billing periods, then the average amount of the Customer's expenses is considered equal to the amount of expenses for the last billing period.

 

Compensation cannot exceed 100% of the average cost of the service for the previous 3 billing periods.

 

During the test period, compensation for the unavailability of the Contractor's services is not charged.

 

8.4.1. Limitations when using the Cloud VPS OS service

 

8.4.1. The restrictions specified in section 8.4.1 of these Rules may be increased at the request of the Customer. The Contractor makes the final decision on this request and may reject it without giving reasons.

 

8.4.2. For an account in the cloud, the following restrictions on the use of unlimited traffic are set:

 

The bandwidth of the virtual server port is limited to 300 Mbps for general (incoming and outgoing) traffic.

If the port bandwidth is occupied at the level of 290 Mbps or more by outgoing traffic from one IP address for 30 minutes, the bandwidth of the corresponding virtual server can be reduced to 10 Mbps until the end of the calendar day, Kiev time.

If the port bandwidth is occupied at the level of 200 Mbps or more by outgoing traffic from one IP address for 60 minutes, the bandwidth of the corresponding virtual server can be reduced to 10 Mbps until the end of the calendar day, Kiev time.

8.5. Limiting the capacity of virtual servers

 

8.5.1. Depending on the amount of the last replenishment of the balance of units (1 unit = $1 or equivalent in another currency), the client can create servers of various configurations in the cloud:

 

Available when replenishing the balance for any number of units:

 

Number of virtual processors: from 1 to 4.

The amount of RAM of one server: from 1024 MB to 8192 MB.

Available when replenishing the balance by 85 units or more:

 

Number of virtual processors: from 4 to 8.

The amount of RAM of one server: from 8192 MB to 24576 MB.

Available when replenishing the balance by 209 units or more:

 

Number of virtual processors: from 8 to 24.

The amount of RAM of one server: from 24576 MB to 92160 MB.

8.5.2. The customer has the possibility of short-term use of servers with 4 virtual processors and 8192 MB of RAM without replenishing the balance for 85 units or more. To obtain this right, the Customer must contact the Contractor's support service, explaining the need to expand the server configuration for a short period of time and justifying the reasons for the increase in load. The Contractor makes the final decision on this request and may reject it without giving reasons.

 

8.6. Suspension and removal of Cloud VPS OS service for non-payment

 

8.6.1. Units provided to the Customer during the trial period can be used within 35 days. After the expiration of this period, the rest of the units becomes unavailable, and the provision of the service is terminated. If within 35 days from the date of activation, the client replenishes the Cloud VPS OS balance by 10 units or more, the remaining units are saved and can be used at any time.

 

8.6.2. During the trial period of 35 days, the service will be terminated in case of non-payment upon reaching a zero balance. After the first paid top-up of 10 units or more, services are terminated on the third day after reaching zero balance, while maintaining the average monthly consumption of units. Thus, a significant increase in unit consumption after reaching zero balance may lead to an earlier termination of the service than on the third day after reaching zero balance.

 

8.6.3. Suspension of the service for non-payment means disconnecting all virtual servers of the client and blocking access to the cloud control panel. At the same time, all data on the servers and general cloud settings are saved. At the same time, the write-off of units continues for resources, the use of which is not affected when the service is suspended: disk, IP address, network, disk snapshot, virtual machine image. Thus, the balance of units on the stopped account becomes negative.

 

8.6.4. Along with the suspension of the Cloud VPS OS service, the 10 GB CDP backup service (free) is also terminated.

 

8.6.5. To resume the provision of the service, it is necessary to replenish the balance of units in such a way that after replenishment the balance becomes positive. If the balance of the paid package is not replenished within 27 days from the date of suspension of services, the Customer's account in Cloud VPS OS is permanently deleted along with general settings and data. If the balance of the test package is not replenished within 3 days from the moment of suspension of services, the Customer's account in Cloud VPS OS is permanently deleted along with general settings and data.

 

8.6.6. The 10 GB CDP backup service (free) is deleted 30 days after ordering the Cloud VPS OS service, along with all data backups, if any.
